DIVORCE  OPTIONS  &  FEES

At Divorce by Internet you may choose the level of service option which suits your unique circumstances.

1.    DIVORCE  OPTION 1:    R 10 000  -  'Unopposed divorce'

2.    DIVORCE  OPTION  2:     R 2500    -  'Unopposed divorce'                   

3.    DIVORCE  OPTION  3:  Cost on request       
             3.1    LEGAL ASSISTANCE such as an ADVOCATE to assist you in court on your                     divorce date. (usually really not necessary)

         3.2    WHERE THE DEFENDANT PERMANENTLY LIVES OVERSEAS

         3.3    WHERE THE DEFENDANT IS MISSING / DISAPPEARED

         3.4    HIGH COURT MOTIONS:  WHERE THE CUSTODY and/or 
        
           VISITATION RIGHTS OF MINOR CHILDREN ARE INVOLVED and/or 

                   CASES WHERE YOU REQUIRE A LIQUIDATOR TO DIVIDE YOUR ASSETS                       IN COMMUNITY OF PROPERTY WHETHER YOU HAVE ALREADY                                     OBTAINED YOUR DIVORCE DECREE OR NOT.

DIVORCE  OPTION 1   -    R 1500 (vat incl.)   -  'Unopposed divorce'

(Plaintiff and Defendant may reside anywhere in South Africa)

Upon receipt of the above amount into our bank  account, we forward our online application form to you for completion, which form contains all relevant questions to process the Divorce Summons and relevant documentation including your Settlement Agreement in accordance with the settlement reached between you and your spouse. 

Upon receipt of your fully completed application/questionnaire your divorce documentation is automatically processed by our computer system. Once your documents have been checked by a legal professional,  we return your complete set of divorce papers to you, via e-mail / fax / post,  within a few days for your approval.  Thereafter, your take over the further handling of your divorce. We also furnish you with an easy step-by-step guide which explains how to proceed in obtaining your divorce i.e. making various copies for the court, applying the revenue stamp, filing with the court, arranging service of the papers on your spouse by the Deputy Sheriff, in the event if there are minor children involved a copy of the Summons must be delivered to the Family Advocate,  notice of Set Down for a court date, and the brief appearance of the Plaintiff in court to obtain your final divorce decree.

If you choose this option, we process your divorce papers and Settlement Agreement. (if you require a Settlement Agreement, it is processed free of charge based on the information you provide to us. There is a time limit to this free offer of 3 months from the day on which you make payment in respect of your divorce. (Please remember it remains the responsibility of the plaintiff to obtain his/her spouses' signature to the Settlement Agreement once we have generated this document according to the Plaintiff's instructions and the Plaintiff is further responsible for the cost of Sheriff's fees of approximately R100-R150. In the event that there are minor children involved, we will assist you with a proposed parental plan, free of charge, if required).
 
 
You do have free e-mail support until your divorce decree is granted subject to a maximum period of 3 months.(This time period is more than adequate in which to complete your divorce since it usually takes about 4 to 8 weeks to obtain an unopposed divorce.


Divorce Option 1,  is by no means inferior to Divorce Option 2, however Divorce Option 1 requires a substantial amount of work on your part whereas with Option 2, we do all the work and queuing on your behalf,  pay the Sheriff's fees on condition that the Defendant collects his copy of the papers from any Sheriff's office of Defendant's choice anywhere in South Africa,  allowing you peace of mind.

DIVORCE  OPTION  2:  R 7000 (vat incl.)  -  'Unopposed Divorce'
(Monthly payment plan available for Divorce Option 2. Max 5 equal installments. All documents will be processed upon receipt of 1st installment and issuing and further processing upon receipt of final payment).


(The cost of R 7000 is only applicable if the Plaintiff (spouse who applies for the divorce) lives in the Gauteng area, however the Defendant may live anywhere in South Africa). 
(For cases where the Plaintiff lives in areas outside of Gauteng, please enquire regarding possible additional cost since courier costs may be higher).


Upon receipt of your payment, we forward our application (questionnaire) to you for completion.

After completion,  you return the Application form to us and upon receipt thereof, your divorce papers are automatically processed by our system. If required, we also process a Settlement Agreement for you free of charge in accordance with the information provided to us. Please note that you remain responsible for obtaining your spouses' signature to the Settlement Agreement.
There is a time limit applicable to this free offer,  of 3 months from the day on which you make payment in respect of your divorce.

The completed documents are then returned to you via e-mail / fax / post /courier within a few days for your approval and signature.

Once you have signed your papers, we arrange to collect the papers from you via courier or we may request you to send papers back to us by post depending on where you reside.

If you choose this option, we arrange for issuing the divorce Summons at the High court on your behalf. We also complete the Statistics form for Home Affairs on your behalf.

We then arrange for service of the papers on your spouse by the Deputy Sheriff and pay the Sheriff's fees provided your spouse is willing to collect his divorce papers from the Sheriff's Office of his choice, anywhere in South Africa.
(In the event that the papers require service on the Defendant at any other location, all Sheriff's fees payable shall be paid by the Plaintiff to us in advance, after which we shall instruct and pay the Sheriff's fees accordingly).

We arrange for the Return of Service to be collected from the Sheriff concerned and file it with the Court.

If minor children are involved, we provide the Family Advocate with a copy of the Summons and related documents. We assist you with a proposed parental plan free of charge.  (However, in certain circumstances, the Family Advocate may wish to discuss the minor children with the parties per telephone or in person). We collect the report from the Family Advocates Office and file it on your court file.

We arrange for a Court date.

The Plaintiff is required to appear briefly in Court on the Court date. We give guidance free of charge.
 
We collect your divorce decree when ready.

You also have free e-mail support until your divorce decree is granted subject to a maximum period of 3 months
which is more than adequate since an unopposed divorce is usually complete within 4 to 8 weeks.

DIVORCE  OPTION  3:  Cost on request       
In addition to our services as set out under Divorce Option 2, we assist with the following services:

3.1    LEGAL ASSISTANCE ON YOUR COURT DATE
          Should you feel that you require legal assistance on your divorce court date,
          we will request our attorneys to look at your case and arrange for an Advocate
          to assist you in court on the day of your hearing. In this way you only pay for
          the cost of an Advocate at your trial and not for your entire divorce. Please
          contact us for a quote but bear in mind this should be done prior to obtaining
          a court date alternatively,  your court date may have to be postponed.

3.2    WHERE THE DEFENDANT PERMANENTLY LIVES OVERSEAS

Most divorces are UNCONTESTED however in the event that your divorce is
            defended by your spouse,  you require the assistance of a qualified attorney who
            specializes in matters of this nature and one who you can trust.
 
            Or, in the event that your divorce started out as being "UNCONTESTED" but
            your spouse afterwards decides to defend the matter, the case must be handed
            over to an attorney for further handling.
